I, A , D/o xxxxxxx R/o xxxxxxxxx do hereby solemnly affirm and declare as under:
- That I am the complainant in the above noted case and am duly conversant with the facts of the present case.
- That the opposite party is a real estate company who runs its business by developing the building for residential and commercial units in various parts of India.
- A true copy of the agreement with opposite party is filed as Exh. CW1.
- That at the time of booking of shop in the said Mall, the opposite party assured and represented to complete the construction of the Mall within a period of thirty months of commencement of construction with an extended period of Six Months.
- That as per the Construction linked payment plan adopted by me, I paid Rs. 000000/- towards the basic price of the shop up to the date of singing of the agreement and the receipt of which the opposite party acknowledged in the agreement itself at S. No. 5 a. I paid the above said amount vide Cheque No 00. A true copy of my ledger produced by opposite party is exhibit as Exh- CW-2.
- That even after a lapse of 8 years, the construction at site is yet to commence. On account of this I am incurring very heavy loss and mental disturbance.
- I declare and affirm that before moving to the Hon’ble Forum through complaint, I issued a legal notice to the opposite party to give some of Rs. 000000/- along with interest @ 24% p.a.. A true copy of legal notice is exhibit as Exh-CW-4.
